Taxation for Spanish Residents
USDC interest, 8LNDS receipt and capital gains all count — and since 2026 DAC8 sends your crypto data straight to the Agencia Tributaria. Here's how a Spanish resident stays compliant.
Residents of Spain pay tax on income from 8lends as savings income on a progressive scale of 19–30%: this applies to interest income in USDC (19–25% APR), to the receipt of 8LNDS, and to capital gains from sales. The declaration is filed via Modelo 100 by June 30 of the following year. If crypto assets on foreign platforms exceed €50,000, Modelo 721 is additionally filed. As of 2026, DAC8 is in effect — the Agencia Tributaria receives data on crypto transactions automatically. This article is a general guide, not individual tax advice.

The scale is progressive — each "tier" has its own rate applied to it; not the entire amount is taxed at the top rate.
Three types of income on 8lends — tax treatment
Interest income in USDC (19–25% APR)
- Monthly interest payments from investments
- Taxed as savings income (rendimientos del capital mobiliario)
- Declared in Modelo 100 in the savings income section
- FIFO for cost basis calculation
Example: an investor invested 10,000 USDC at 22% per annum → over a year received 2,200 USDC in interest ≈ €2,000 (at the rate of 1.10) → tax: 19% × €2,000 = €380.
Receiving 8LNDS through Proof of Loan / referrals
- At the moment of receipt, taxed as savings income at market value
- Scenario: received 40,000 8LNDS at a price of $0.001 = $40 (≈ €37) → this income is declared in the year of receipt
- Cost basis of the new 8LNDS = €37
Tax upon receipt: 19% × €37 = €7.03.
Capital gains on selling 8LNDS or positions
- If you sell 8LNDS on Uniswap → capital gain = (sale price − cost basis)
- If you sell a position on the Secondary Market → also a capital gain
- Taxed as savings income on the same 19–30% scale
Example: a year after receiving 40,000 8LNDS at €37 — sold at €111 → capital gain = €74 → tax 19% × €74 = €14.06.
Modelo 721 — mandatory declaration for crypto abroad
Since 2024, Spain has introduced a mandatory Modelo 721 declaration for crypto assets:
Filing conditions:
- Crypto assets are held on foreign platforms (including non-custodial wallets associated with foreign services)
- The total value as of December 31 exceeds €50,000
- Includes: exchange balances, wallets, lending protocols, NFTs
Filing deadline: by March 31 of the following year.
Penalties: for non-filing — large fines, a minimum of €5,000 per group of unreported data.
⚠️ This is an additional informational declaration, not a tax. But non-filing, even without any tax liability, leads to fines.
Does Modelo 721 apply to 8lends?
- 8lends is operated by Alpha Systems LLC (Saint Vincent and the Grenadines) — a foreign company
- The base blockchain is Base (Layer 2 Ethereum), technically global
- The investor's wallet is non-custodial — formally under their control
In most interpretations, 8LNDS in an investor's wallet do not fall under Modelo 721 (this is your private wallet, not a foreign platform). But if you have a large portfolio — be sure to consult a Spanish tax advisor for correct classification.
Wealth tax (Impuesto sobre el Patrimonio)
If net assets exceed €700,000 (regional thresholds may differ):
- Rate — from 0.2% to 3.5% (depends on the region)
- Regional differences: Madrid has a zero rate, Catalonia and Andalusia — higher
- Includes crypto at fair market value as of December 31
- Additional declaration: Modelo 714
Cost basis in Spain — mandatory FIFO
In Spain, FIFO is used (in Spanish PEPS — Primero en Entrar, Primero en Salir):
- The first tokens purchased / received are the first sold
- This is a mandatory method, the investor has no choice
- HIFO and LIFO are not applied in Spain

Losses and carryforward
- Capital losses can be offset against capital gains of the same year
- Unused losses are carried forward for 4 years against future savings gains
- They are not offset against general income (salary, business income)
Example: if in a year you received €1,000 gain from 8LNDS, but €500 loss from another crypto asset → taxable base = €500.
DAC8 as of 2026
As of January 1, 2026, DAC8 is in effect in Spain — the European directive on the exchange of tax information on crypto assets:
- Crypto exchanges automatically transmit data to the Agencia Tributaria
- The first reports will be filed between January and September 2027
- Evasion becomes practically impossible for assets on trackable platforms
- DAC8 is extraterritorial — it applies to any platforms serving EU residents
This means: a correct declaration is now not a choice, but a necessity.

- Through the Renta Web portal on the Agencia Tributaria website
- Deadline — by June 30 of the following year
- Can be done through a tax advisor (gestor)

How much tax will I pay on €1,000 of interest income from 8lends? With total savings income up to €6,000 per year — the rate is 19%. That is, on €1,000 — €190 in tax. This includes all savings income (USDC interest + 8LNDS + other capital income) — the sum is added together before applying the progressive rates.
How do I declare 8LNDS if I haven't sold them yet? At the moment of receipt, their market value is already taxed as savings income. That is, tax must be paid in the year of receipt, even if you didn't sell. Upon future sale — the capital gain is calculated from the cost basis = the value at the moment of receipt.
Does Modelo 721 apply to 8LNDS in my MetaMask? In most interpretations — no, because MetaMask is your personal non-custodial wallet, not a "foreign platform" in the exchange style. But large portfolios (>€50,000) must consult — Spanish tax rules in crypto are evolving, and interpretations may differ. It's best to check with a specialized gestor.
What if I live in Spain under the Beckham Law? The Beckham Law (régimen especial) gives a 24% flat rate on Spanish-source income up to €600,000 per year for qualifying expats. Income from 8lends in this case is considered foreign (Alpha Systems LLC + Base blockchain) → it may not be taxed in Spain under the Beckham Law. This is a complex area — be sure to consult a tax advisor.
What if I'm in the Basque Country or Navarre? The Basque Country and Navarre have their own tax systems (foral). Savings income rates may differ from the standard Spanish ones. Check with a regional advisor.
How long should I keep documents? At least 5 years from the moment of filing the declaration — the Agencia Tributaria standard. For large portfolios, 7+ years is recommended in case of an audit.
How do I declare losses from investments on 8lends? If a project defaulted and you lost part of your investment — this is a capital loss. It's declared in Modelo 100 and offset against gains of the same year. Unused losses are carried forward for 4 years.
What if the tax year has ended and I haven't declared? It's possible to file a corrected declaration (declaración complementaria) — with reduced penalties. The sooner you correct it — the smaller the penalty. Contact a gestor urgently.
Does VAT (IVA) apply to income on 8lends? No. According to ECJ clarifications (case Hedqvist), crypto transactions are exempt from VAT. IRPF (income tax) remains applicable.

And what if I'm a citizen of the Russian Federation, but a tax resident of Spain? Spanish tax residency is about place of residence, not citizenship.
